Councillor Ana Bailao’s drunk driving case goes to court on Monday.
Bailao (Ward 18, Davenport), a swing voter who has played a key role on the social-housing file, faces charges of impaired driving and of driving with a blood-alcohol level higher than the legal limit.
She was stopped at around 1:45 a.m. on Oct. 16 near Bathurst and Harbord Sts. She had attended the Mayor’s Ball for the Arts earlier in the night.
Bailao said on Oct. 17 that she intends to plead not guilty. Her executive assistant referred questions to her lawyer, Peter Thorning, on Friday.
Thorning said Bailao will not personally attend court on Monday. He said the case will be put off to a later date, as is standard practice, so he can review evidence and schedule a meeting with the Crown.
“It’ll be a two-second appearance,” he said. The hearing will be held at Old City Hall, Courtroom 111, at 11 a.m.
Bailao, who was first elected in 2010, has continued to perform her regular duties since she was charged.

A little less than four hours after Bailao (Ward 18, Davenport) left the Mayor’s Ball for the Arts Monday night, an officer from 14 Division spotted the 36-year-old councillor driving north on Bathurst St. without her car lights on, a police source said.
Initially, she didn’t pull over for police. She was stopped at Bathurst and Harbord Sts. at 1:47 a.m — four minutes after the first sighting, said the source.
The centrist councillor was charged with impaired driving and driving with a blood alcohol level of 80 mg per 100 ml of blood. The latter charge indicates she submitted to a breathalyzer test.
On Wednesday, Bailao said she could not comment on details of the allegations, as the issue is before the courts. She would not say how many drinks she consumed before getting behind the wheel.
It’s not clear where Bailao was between the time she left the ball, around 10 p.m., to the time she was apprehended, but a number of councillors were planning on going out to the nearby Thompson Hotel lounge at Bathurst and Wellington Sts. after the event.
A Thompson Hotel official said the hotel is not commenting.
