B.C. rights tribunal orders gym to pay $1,900 to patron whose ‘dignity’ was violated by hiking boot ban

Keith Wollenberg was under orders from his physiotherapist: If he did lunges at the gym, he had to wear hiking boots to support his arthritic toes.

But when the management at Platinum Athletic Club in Surrey, B.C., refused to make an exception to its dress code allowing only athletic shoes in April 2011, Mr. Wollenberg sensed a human rights violation. And B.C.’s Human Rights Tribunal has now agreed, ruling the footwear discrimination injurious to Mr. Wollenberg’s “dignity, feelings and self respect.”

In a decision document released last week, the tribunal chairman ordered the gym to pay Mr. Wollenberg over $900 to make up for the membership he rarely used, as well as the wages and parking fees he sacrificed while pursuing the complaint. The chairman also ruled that the gym should pay Mr. Wollenberg another $1,000 to compensate for his loss of dignity.
