Because it depends on what led to their actions and how they respond afterwards.

If someone's constantly harassed or bullied and they retaliate in kind then you can clearly identify that they were in a compromised state at that particular moment and hopefully they regret the action immediately and apologise immediately.

However, if some rich white guy is slandering the n word and only fesses up after being roundly ridiculed for his stupidity, the tone is completely different and he might be in line to lose his job.
