How do we expect Russia to fix the Crimea conundrum before we drop trade sanctions?

It was an illegal annexation, but one that the majority of the local population of the annexed region supported.

We are now exercizing economic sanctions against Russia until it fixes the problem. But what do we understand by fixing the problem?

Those who actively promoted the annexation ought to be punished since it was illegal. However, what do we do to reverse it? Do we return Crimea to Ukraine now that the majority of Crimeans have voted to join Russia?

I suppose we could insit on a new internationally-monitored referendum, and Crimea will probably vote to join Russia again. And if it does, then what? Do we then consider the problem fixed and remove the sanctions? Or do we intend that it be fixed some other way?

Do we punish all Russians for this? Do we punish Crimeans for this? That would be ironic seeing that the Crimeans are the one's we're supposedly sympathising with.

If we decide that Crimean annexation is now irreperably a fait accompli due to popular support for annexation in Crimea itself, and don't want to punish Crimea for its supposedly being a victim (a very willing and even enthusiastic one at that), but still think someone ought to be punished, do we just blacklist any Russian politician who'd voted for its annexation, making him a persona non grata in our country? If that satisfies us, do we then drop the trade sanctions, or do we expect something else before we drop trade sanctions?

Exactly how do we expect Russia to fix this before we drop the sanctions?

The Supreme Council of Crimea considered the ousting of Ukrainian President Viktor Yanukovych in the 2014 Ukrainian revolution as a coup and the new interim government in Kiev as illegitimate and stated that the referendum was a response to these developments.

the official result from the Autonomous Republic of Crimea was a 96.77 percent vote for integration of the region into the Russian Federation with an 83.1 percent voter turnout.

It's a conundrum if you believe in international law and democracy. According to international law, the referendum was illegal. According to democracy, it was democratic. If a person values both, he's divided. I personally consider international law to be even more important than democracy since it can help to protect the minority from the tyranny of the majority.

In that sense, I vehemently oppose Putin's intervention in Crimea.

However, when I think of a just resolution, none comes to mind.

If I understand the present policy, it's that we will lift sanctions against Russia when Russia returns Crimea to Ukraine.

I understand that and agree with it on the surface. According to international law, Crimea is Ukrainian territory and Russia violated Ukraine's sovereign territory.

But at the same time, we now have a referendum in which the Crimean 'victims' welcomed the invaders with open arms?

That's what makes it so damn complicated and makes a resolution so damn complicated.

This document is a member of the Board of EA Bobrov, the head of the network "Migration and Law" HRC "Memorial" SA Gannushkina and lawyer Tseytlina OP Network as a result of visiting the cities of Sevastopol and Simferopol in the period from 15 to 18 April 2014, meetings with officials of the state authorities, clergy, journalists, public figures, lawyers, human rights activists and citizens. Citizenship According to Part. 1, Art. 4 of the Federal Constitutional Law of March 21, 2014 N 6-FKZ "On the adoption of the Russian Federation Republic of Crimea and the formation of the Russian Federation subjects of the new Republic of Crimea and the federal city of Sevastopol" (hereinafter - the Law) by citizens of the Russian Federation recognized as citizens of Ukraine and stateless persons permanently residing in the Crimea on March 18, 2014, with the exception of persons who, within one month after this date they declare their desire to maintain their existing and their minor children of another nationality or remain stateless (refuse . recognition of the citizens of the Russian Federation) There were the following problems: 1) Although the information on the FMS website to confirm the stay is not only information about the place of registration zhitelstva1 face problems in the issuance of passports to many residents of the Crimea - Ukrainian citizens, foreign citizens and persons without citizenship, permanently living in the Crimea, but have no residence registration. The divisions FMS of Russia in Simferopol and Sevastopol, there is no information on the possibility of this category acquire citizenship of the Russian Federation. 2) Availability of premises in the property even in the absence of registration it is the basis of registration of Russian citizenship (decision on documentation was adopted in each case, taking into account the specific circumstances ). 3) Submission of preserving Ukrainian citizenship, and as a result of non-recognition of a citizen of the Russian Federation has become really possible only with the April 1, 2014 in Simferopol was originally only one regional office to function accepting applications for renunciation of citizenship of the Russian Federation, and only 3 branches in all the Crimea (Simferopol, Belogorsk, Bakhchisarai) is now open 8 branches (Yalta, Evpatoria, Saki, Feodosia, Djankov, Simferopol, Sevastopol, Bakhchisarai), but this was not enough, as a result of citizens actually were prevented in time to file such a statement. Many citizens in the absence of objective, complete and accurate information about the future position of "non-citizens" of Russia in the Republic of Crimea and Sevastopol is still not able to correctly assess the situation, and therefore also failed within the prescribed period to April 18, 2014 take a fundamental decision for themselves to acquire Russian citizenship, or the preservation of Ukrainian citizenship, which entails the rejection of recognition of Russian citizens. 4) Many state employees threatened with dismissal, while maintaining their Ukrainian citizenship, and as a result of non-recognition of Russian citizenship (although related to the nationality restrictions in the form of activities in the Russian legislation does not, if it is not a state or municipal office). 5) Many of the Crimean Tatars have to take Russian citizenship, because they have land shares of agricultural land, which under Russian law could be provided to the property only to citizens of the Russian Federation. Residents fear that many will not be able to get a passport before the elections to the regional and local authorities of the Crimea, scheduled for September 14. according to information from the deputy head of the Federal Migration Service of Russia in the Crimea Frolova AM, by mid-April: - issued about 170,000 passports of citizens of the Russian Federation (according to FMS of Russia on 19 April - about 300,000) - about 1,200 people gave up Russian citizenship, of which only 8-10 people Crimean Tatars (according to information from the Federal Migration Service of Russia on 19 April - about 3,000 people). - for the whole period (1 month) in the Russian Federal Migration Service unit in the Republic of Crimea was charged with only one judgment in the case of establishing the fact of permanent residence in the Crimea on the above-named date. In acknowledgment of this fact is denied because of the message by the applicant, according to the court, false information. The whole documentation of Russian passports is very slow, the queue for obtaining passports lined up for several months (for example, only in one spatial point in Sevastopol record number exceeds 30,000 ). According to various estimates, for the certification of the entire population of the Crimea it takes at least 15 months, although the Russian legislation is allocated only 3 months. According to virtually all of the respondents citizens wishing to keep the citizenship of Ukraine Russian Federal Migration Service employees do not explain the rules of law on the Legal Status of Foreign Citizens in the Russian Federation : the need to travel for 90 days, the period of authorized stay of 90 days during every 180 days, the provisions of the administrative responsibility for violation of the rules of stay, providing to date in accordance with Art. 18.8 h. 1 of the Administrative Code fine with expulsion or not, and others. Although personal statement about the desire to keep the citizenship of Ukraine has a column "refuses to recognize themselves and their minor children of the Russian Federation citizens with the legal status of foreign citizens, stateless persons and the need to design the appropriate instrument, as well as the legal implications of the decision I have read. " The number of persons without citizenship in the Crimea on 1 January 2014. -. 462 people in newly issued Russian passports to the issuing authority specify the Federal migration service of Russia without specifying the name of the territorial authority since in the Crimea, they are not yet in. Registration (registration) Due to the fact that the Ukrainian authorities have closed access to the database records every apartment, in a newly issued passport does not give residence registration. If there is no uncertainty in the registration in the passport is stamped on the registration of residence, without specifying the name of the territorial body of the Federal Migration Service of Russia. Refuge in the Crimea have a refugee status to 18 people. Their legal status is in no way the law is not settled, as well as the unresolved legal status of persons in the procedure of registration of Ukrainian citizenship, residence in Ukraine or in the asylum procedure, but did not receive data status on March 18, 2014. Following the decision of the Federation Council of giving permission to the Russian President on the deployment of troops in Ukraine there was a significant wave of migration from the Crimea in Ukraine, is now migrating to Ukraine is insignificant. Registration of real property rights Ukraine has closed access to the databases of technical accounting of real estate information (BTI), and registration of real property rights, and the Russian government immediately seized the documentation from all territorial BTI in relation to the need for the prevailing conditions and making pereinventarizatsii in Russian accounting. The housing market "rose." In Ukraine, the mandatory notarial form of real estate transactions. The lack of a title document on the property greatly complicates the design (state registration) rights to it. The food and the products due to the current device industry and agriculture Crimea independently provides its own needs only 70%, the rest were imported from Ukraine. Until recently, there was different pricing on products and goods: the prices of goods in Simferopol is much lower than in Russia. After the elimination of border customs entrepreneurs from Krasnodar began buying goods and products for sale in mainland Russia. In order to prevent rising food prices and products requiring urgent conservation measures commodity and food balance and overall reorientation produktosnabzheniya and turnover in the Crimea from Ukraine to Russia. Educational institutions at all Simferopol was only one Ukrainian gymnasium in which the training took place in the Ukrainian language. She is now shifting towards training in Russian. In essence, the only specialized Department Ukrainian-Tatar philology at the Tauride Federal University is closed, too. It is necessary to restore education in Ukrainian gymnasium and the above-named Department of the Ukrainian language. Interethnic relations in recent years significantly worsened inter-ethnic relations on the principle of "friend or foe", open ethnic clashes and irresistible hatred manifestations as a whole is not. Religion and church organs of the new state government decided to actually eliminate the Orthodox church Kiev Patriarchate, currently experiencing difficulties in extending the lease of the building, which occupies the church Kiev Patriarchate. In the mosques, and in fact in any Islamic family has current books Hizb-ut-Tahrir and other Islamic literature. Officially, this literature is banned by the Supreme Court of Hizb-ut-Tahrir as extremist organization, but in Ukraine it was banned and its literature is freely distributed in the mosques. For example, the religious community "Davet" won a lawsuit about its closure, Ukrainian court has not found in the organization of incitement to religious hatred. Currently, the organization is subject to the effective pressure law enforcement agencies, like other followers of the above flow. The resonant murder, detention and abduction of citizens caused widespread resonance of the brutal murder of the Crimean Tatar Reshat Ametova, born in 1975 He expressed his personal silent protest near the parliament of Crimea captured, according to witnesses - stood and looked into the eyes of the so-called samooborontsam, guarding the building, and the next day, the morning of 3 March, went from house to the military enlistment office and disappeared. His body was found on March 15 in a field near. Strawberry Belogorsk district - with signs of torture, his head was wrapped in duct tape, handcuffs on his feet. According to investigators - was killed in a road accident. We left the dead man's wife and three children, the youngest of 2.5 months. Then exported outside of the Crimea on Chongar (Kherson region.) With the threat not to enter the Crimea for 30 years. As of April 17, abducted Crimean -. 3 people, and they are not of the Crimean Tatars. Banking system. Pensions and social benefits The banking system is experiencing great difficulties with the transfer of funds. Due to the nationalization of banks Privatbank actually ceased to serve private clients. None of the major international Russian banks (including Sberbank) can not enter into the Crimea, to recognize foreign states occupied territory, as in this case deprived of international status. For the arrival of international banks in the Crimea (including Russian) The National Bank of Ukraine will impose large fines. The day after the referendum, all social benefits were stopped. The Ukrainian authorities have stated that all citizens retained the citizenship of Ukraine, payment of pensions and social benefits It will be continued in full. However, now it is not clear when restored full banking service of individuals. Anyway, right now, the issue of payment of pensions and allowances to residents of the Crimea to the Crimea in nearby regions of Ukraine with bank cards. The greatest concern is the payment and receipt of funds from deposits discovered in Ukrainian banks by citizens, acquire the nationality of Russia. Also it raises questions and repay bank loans. The judicial system in h. 2 tablespoons. 23 of the Federal Constitutional Law of March 21, 2014 N 6-FKZ "On the adoption of the Russian Federation Republic of Crimea and the formation of the Russian Federation subjects of the new Republic of Crimea and the federal city of Sevastopol" contains a reservation of the action in the Crimea, Ukrainian and Crimean laws 31 December 2014 at the same time, the judicial system has been translated into Russian law, a preventive measure sanctioned by the Code, judgments began to be imposed in the name of the Russian Federation. In accordance with Art. 8 of the case taken to production and not considered at the March 18, 2014 the case must be dealt with according to the rules defined by the relevant legislation of the Russian Federation, but in practice there are problems in the proceedings, especially criminal and administrative, in which the existing norms of the Russian legislation reduces, abolish, exempt or, on the contrary, tighten or introduce new responsibility, guarantee other rights (eg the right to a jury trial) compared with the norms of existing legislation. The media worrying is the situation for the media. To close a number of Internet portals, publications of different directions ( "AN-Crimea", "Events of Crimea", "Crimean time", "Republic"). According to the media, the Russian legislation creates a lot of restrictions, and therefore the quality of journalistic work inevitably decline. Business with the case of raiding on the part of the inhabitants of the Crimea Russian colleagues have not yet encountered, it was during the reign of Yanukovych. In Sevastopol raid felt weaker than in other regions of the Crimea. Land and position of the rural population when people were given land shares, which is virtually impossible to be isolated in nature, intervened in the case of land traders, by simple business schemes deceiving farmers. As a result, the vast majority of the land was in the ownership of merchants. Meanwhile, in the Crimea there are no big farms. Tourism Revenue from tourism in the budget of the Crimea and Sevastopol were minor, come mainly treated patients with broncho-pulmonary diseases. Foreign international tourist companies in the Crimea can not come because of the fear of heavy fines. The referendum According to almost all respondents experts and citizens: - the vast majority of the inhabitants of Sevastopol voted in a referendum for annexation to Russia (50-80% turnout), in the Crimea on different according to join the Russian 50-60% of the voters voted for a total turnout of 30-50% - residents of Crimea voted not so much for joining Russia, but for the termination, in their words, "corruption and lawlessness thieves dominance Donetsk henchmen." Residents of Sevastopol vote for joining Russia. Fears illegal armed groups in Sevastopol were higher than in other regions of the Crimea. Suggestions: 1. To extend the period for acceptance of the inhabitants of the Crimea decision to retain the citizenship of Ukraine, at least until December 31, 2014 2.

According to this purported report about the March referendum to annex Crimea, the turnout of Crimean voters was only 30 percent. And of these, only half voted for the referendum–meaning only 15 percent of Crimean citizens voted for annexation.

The situation is very tense. Islam. State power bodies of the Crimea was converted from Islam religion in protest ideology. Ivan settlers propagating in Crimea Quran in Russian, was detained by police on referendum day, 16 March, and tortured, all this time it has not allowed a lawyer.

So maybe the solution is to make a deal with Russia. Russia calls an internationally-monitored referendum in Crimea to decide whether Crimeans wish to join Russia or join Ukraine, and Russia repsects the will of the people of Crimea. In return, we will drop sanctions on Russia once the will of the Crimean people is respected. Would that bs the best resolution to the problem? Unless you can propose a better solution?

15% of Crimeans voting make the vote null and void. It's a flat out invasion.

https://en.wikipedia.org/wiki/Crimean_status_referendum,_2014

It appears to have been an over 80% turnout, but the problem with the two questions is that neither maintained the status quo. Both questions led to de facto secession. That makes the answers leading. It would be like a Quebec sovereignty referendum asking whether Quebecers wanted Quebec to totally separate from Canada or become an autonomous region of Canada, with neither option supporting the status quo. It's a leding and manipulative ballot.

I just realised that now. If that's the case, then yes, Russia should return Crimea pronto. But you know Russia could checkmate again by deciding to hold a more legitimate referendum if it thinks it can win it. Then what?

If it doesn't return Crimea or call a referendum, we just keep indefinite sanctions until it does? That can go on for decades.

If it calls an internationally-monitored referendum? The international community could refuse to participate, of course. But then Russia could say it's not it's fault there were no international monitors. But what if that referendum includes the option of returning to Ukraine and it's a clear two-option question and the majority vote to stay in Russia? Then what?

Given the leading ballot questions, obviously something needs to be done beyond sanctions? Do we toughen sanctions against Russia to the max but exempt all Crimea-based businesses from such sanctions while requiring all of their exports to be printed in both Ukrainian and Tatar as a pressure tactic? Maybe. Just a thought.

Interesting. As I'm reading, it was the Crimean regional government that chose the ballot question. So that essentially makes them traitors. However, there is at least a possibility that even if a more legitimate referendum was held, it would still vote to stay with Russia. Again, just a mess of a situation.

Looks like the referendum was in part a reaction to the deofficialization of the Russian language. One question was to remain part of Ukraine but under the old constitution in which Russian was a protected language, or join Russia, but the status quo at the time of the referendum was not on the ballot.

There is dispute though, some saying voter turnout was between 30 to 40%. So no clear agreement on that either.

Gallup and other polls soon after the referendum seemd to suggest that the referendum results might have been reflective of the population of Crimea. Confusing.

The referendum was a sham another would equally be a sham.

It was an invasion and sanctions will remain until the occupation ends.

There is no international law. Ask the Americans. They have surely never heard of it. The term exists only to point out a giant hole in international relations.

The referendum was a sham another would equally be a sham.

It was an invasion and sanctions will remain until the occupation ends.

Every country who embraced those sanctions are now talking to Russia about cessation, they all hurt more than Russia and they want what they had before American interferrence in thier economies.

So what do you propose we do?

Do we go to war with Russia to try to force it to hand Crimea back ot Ukraine? I'm sure there would be a valid case for that in international law. Russia did invade another state after all.

Do we maintain sanctions against Russia to everyone's economic detriment as a way to score political points by makig it look like we're tough when we really intend to eventually drop the sanctions later once it's all a distant memory? That's a slimy spineless political shenanigan solution.

Do we admit that we don't intend to really do anything about it and so resume trade with Russia shile simply acknowledging that we will give moral support to any state that chooses to fight Russia to return Crimea to Ukraine? At least that would be an honest solution.

Or do you propose something else?

He has one solution suggested by Americans and that is to attack Russia until it crushes Ukraine. One afternoon should do it. They have got to be simple minded in Ukraine to trust an American plan to the last Ukrainian. He is obviously unaware of what happens to tiny little American allies.

Ukrainian Army in panic, friendly fire claims 45 soldiers

October 21, 2016 - Fort Russ News -
RusVesna - translated by J. Arnoldski -

The non-combat casualties of the Ukrainian army in Donbass over the last week amount to 45 people, 15 of whom were killed. This information was unveiled today to DAN press center by the deputy commander of the Donetsk People Republic, Eduard Basurin.

“The greatest number of these instances were recorded between October 16th and 18th in the units of the 54th mechanized brigade and 56th motorized infantry brigade,” Basurin reported.

In particular, a frequent cause of death among Ukrainian soldiers is the careless use of weaponry on the contact line against their own comrades.

“For example, out of fear of an offensive by our units which the Ukrainian media actively fuels, frightened UAF soldiers began to indiscriminately shoot at neighboring units, mistaking them for the enemy,” Basurin explained.

The DPR’s intelligence regularly reports on the non-combat losses of the enemy, as Ukrainian media is often silent on this. The most common cause of death and injury is collision between UAF units and nationalist battalions involving the use of arms, hazing, inability to handle weapons, and command errors.

That was just to get the majority of citizens to leave so when they held the referendum it gave the result desired ans no one could say it was rigged.

So what do you propose we do?

Go to war?

Keep the sanctions forever and hurt all sides' economies while pretending we're doing something about it?

Admit we don't really intend to do anything about it and so resume trade with Russia?

What are your recommendations?

What to do... nothing to fix.
darkbeaver: There is no international law. Ask the Americans. They have surely never heard of it. The term exists only to point out a giant hole in international relations. That is so true, the fact that putin retained his black sea port despite the cia's best efforts to wrest it from him left the whitehouse smarting. Military already stationed in crimea and a handful of insignia-less guys wandering around hardly and invasion makes but barac did the one thing he is good at... play the drama card.
The eu has felt the pinch of russian sanctions with farmers dumping products they no longer have a market for, why the eu blindly rubber stamps flawed u.s. foreign policy puzzles me. Sanctions cost america diddly as eu nations carry the burden but some have opened their eyes, even really confused france has asked geez why we doing this?
