> CF Regular Force and full-time Reserve Force members are subject to the National Defence Act (NDA) and Code of Service Discipline at all times whether on or off hours and in or out of uniform. This means that they cannot participate in anything illegal and certainly should not be doing so while in uniform. CF part-time (i.e. Cl A) reservists may also be subjected to the NDA and code of service discipline or administrative action. Members wishing to participate in any activities that have potential ramifications on the CF must first obtain permission from the respective chain of command, specifically their CO. COs may give permission or not, considering all the facts of the matter, for example the time, place, activity, people involved, and the safety of any CF members and the general public. Every request must be treated on a case by case basis as it should be individually assessed. COs will likely wish to seek legal opinion based on QR&O 19.44 Political Activity and Candidature for office, Para 8 Note (A) (c).
> A CF member should not participate in the Idle No More movement if this constitutes illegal acts/assembly and/or riots. These acts are criminal acts under the Canadian Criminal Code and the CF member could be charged under QR&O 103.60 Conduct to the Prejudice of Good order and Discipline and/or 103.61 Offence against other Canadian Law. It should be noted that even if an offence does not happen on DND land, it is still a chargeable offence.
> Should a DND civilian employee wish to participate in any of the demonstrations/activities, they are to request vacation or compensatory time off if it is during working hours (excluding lunch). Under no circumstances is "Other Paid Leave" to be granted for this purpose. They are also strongly encouraged to review their impartiality obligations under the Public Service Employment Act.
