A former northern Alberta teacher's aide was put behind bars Wednesday for exchanging nude photos online with two teens who attended her school.
Charmaine Pearl Yuschyshyn, 40, was sentenced to a year in jail, to be followed by two years of probation, after earlier pleading guilty in Court of Queen's Bench to possession of child pornography and two counts of communicating online to facilitate the making of child pornography.
According to agreed facts, Yuschyshyn had X-rated online chats on Facebook and by text with the two 16-year-old boys between Nov. 1, 2012, and Feb. 2, 2013.
Court heard the smartphone conversations between Yuschyshyn and one of the boys started with ordinary chit-chat, then turned sexual.
They described sex acts they wanted to do together and exchanged nude photos.
Yuschyshyn also sent the teen voice recordings of herself while masturbating and asked him to do the same.
Court heard the online chats, which were seized by police, included her suggesting it would be fun for them to be together in a hotel room and described how she would dress in a sexy bra, thong and high heels for him.
Yuschyshyn engaged in similar text conversations with the second boy and invited him to go for a drive so she could perform oral sex on him. They also exchanged nude pictures several times; however, court heard they never engaged in any sexual contact.
Yuschyshyn had also been charged with sexual exploitation in connection with the first teen, but was found not guilty by a jury.
At the trial, which was held in Peace River, Yuschyshyn denied on the witness stand having had sex with the teen. The teen told the jury that they had.
Yuschyshyn's lawyer argued it wasn't actually exploitation as the teen was not a student of hers.
Court heard Yuschyshyn was caught after the mother of one of the teens did a spot check on his cellphone. Yuschyshyn confessed when police confronted her.
On Wednesday, Crown prosecutor Craig Krieger said Yuschyshyn took advantage of her legitimate access to the "naive" and "vulnerable" teens at their school to exploit their trust and establish illegal relationships with them.
Defence lawyer Eamon O'Keeffe told court Yuschyshyn, a mother of two, grew up on a farm near Leduc and left a banking career to be a homemaker, then moved up north with her truck-driving husband for his work.
While on probation, Yuschyshyn is not allowed to work or volunteer with minors. She was also placed on the national sex offenders registry for life.
